Membership Agreement

  1. PARTIES

1.1. Hatun İstanbul İç ve Dış Ticaret Ltd. Şti. located at Merkezefendi Mh. Mevlana Cd. Uygunlar A.Ş. No:112/1 Zeytinburnu/İSTANBUL, which carries out the activities of the website www.hatunistanbul.com (hereinafter referred to as "Hatun İstanbul").

1.2. The internet user who is a member of the website www.hatunistanbul.com (“Member”).

  1. SUBJECT OF THE AGREEMENT

This agreement regulates the terms and conditions regarding the membership of the visitor (Member) to the internet site www.hatunistanbul.com between Hatun İstanbul İç ve Dış Ticaret Ltd. Şti. (Hatun İstanbul) and the Member.

  1. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The Member declares and undertakes that the personal and other information provided while registering as a member on the www.hatunistanbul.com website is true and accurate before the law, and that Hatun İstanbul will be compensated immediately and in full for any damages incurred due to the inaccuracy of this information.

3.2. Visitors must enter their membership account information accurately and up-to-date to become a Member. The Member is solely responsible for all damages that may arise due to not entering and/or keeping their membership account information accurate and up-to-date. The Member cannot give the password provided to them by Hatun İstanbul to other individuals or organizations; the right to use the said password belongs exclusively to the Member. The Member accepts and undertakes that they will keep their created membership account name and password confidential, will not share them with third parties, and will be responsible for any damages that may arise if they share them. Information related to the membership account can be changed and/or updated after logging into the membership account.

3.3. The Member acknowledges that, being aware of the global nature of the Internet, they will comply with all applicable regulations and national and international procedures regarding online conduct rules and acceptable content, and especially all applicable laws regarding the transmission of technical data. The Member accepts and undertakes from the outset to comply with legal regulations and not to violate them while using the www.hatunistanbul.com website. Otherwise, all legal and criminal liabilities that may arise will belong entirely and exclusively to the Member.

3.4. The Member may terminate their membership at any time by making a verbal or written notification through their membership account or otherwise.

3.5. The Member may not use the website in any way that disrupts public order, violates general morality, disturbs or harasses others, for an unlawful purpose, or in a way that infringes upon the intellectual and copyright rights of others. In addition, the member may not engage in activities (spam, virus, Trojan horse, etc.) and transactions that prevent or make it difficult for others to use the services.

3.6. The ideas and thoughts declared, written, and used by members on the www.hatunistanbul.com website are entirely their personal opinions and bind the opinion owner. These opinions and thoughts have no relation or connection with Hatun İstanbul. Hatun İstanbul has no responsibility for any damages that third parties may incur due to the ideas and opinions declared by the member, and for any damages that the member may incur due to the ideas and opinions declared by third parties.

3.7. Hatun İstanbul shall not be responsible for any unauthorized reading of member data or any damages that may occur to member software and data. The Member has accepted in advance not to claim compensation from Hatun İstanbul for any damage they may incur due to the use of the www.hatunistanbul.com website.

3.8. The Member has agreed not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising therefrom belong entirely to the member.  

3.9. The member who violates one or more of the articles listed in this membership agreement shall be personally liable criminally and legally for such violation, and shall keep Hatun İstanbul free from the legal and criminal consequences of these violations. In addition, in the event that this violation leads to legal action, Hatun İstanbul reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.10. Hatun İstanbul reserves the right to change, reorganize, or discontinue the publication of all kinds of services, products, terms of use of the Website, and information offered on the Website, without prior notice. Changes come into effect at the moment they are published on the Website. By using or accessing the Website, these changes are deemed to have been accepted. These conditions also apply to other linked internet pages.

3.11. The member who concludes this Agreement by creating a membership account must give consent for Hatun İstanbul to send commercial electronic messages, including digital marketing, for marketing, promotion, advertising, and similar purposes regarding products and services, within the framework of relevant legislation, and also for notifications related to the membership account. The Member may, at any time, declare that they no longer wish to receive commercial electronic messages by performing the rejection process specified in our commercial electronic messages or through the relevant electronic communication channels. This request of the Member will be processed as soon as possible for the relevant electronic communication channel(s).

3.12. Hatun İstanbul always has the right to unilaterally delete the membership of the member, and to delete files, documents, and information belonging to the customer when necessary. The Member accepts this disposition in advance. In this case, Hatun İstanbul has no responsibility.

3.13. The software and design of the www.hatunistanbul.com website are the property of Hatun İstanbul, and the copyrights and/or other intellectual property rights related to them are protected by relevant laws, and they cannot be used, acquired, or modified by the member without permission. Other companies and their products mentioned on this website are trademarks of their owners and are also protected under intellectual property rights.

3.14. Certain information, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that directly provides connection to the site, may be collected by Hatun İstanbul for the purpose of improving and developing the www.hatunistanbul.com website and/or within the framework of legal regulations.

3.15. Hatun İstanbul may disclose the personal information of the member when required by a legal obligation or when it deems it necessary in good faith to (a) comply with legal requirements or legal processes served on Hatun İstanbul; (b) protect and defend the rights and property of Hatun İstanbul and the Hatun İstanbul website family.

3.16. Measures have been taken within available means to ensure that the Hatun İstanbul website is free from viruses and similar malicious software. In addition, for ultimate security, the user must provide their own virus protection system and ensure necessary protection. In this context, by entering the Hatun İstanbul website, the member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.17. Hatun İstanbul may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning. Every provision that is changed, updated or repealed will be valid for all members as of the date of publication.

3.18. The Parties accept and declare that all computer records belonging to Hatun İstanbul will be taken as the sole and true exclusive evidence, in accordance with the relevant laws, and that the said records constitute an evidence agreement.

  1. TERMINATION OF THE AGREEMENT

This agreement shall remain in force until the member cancels their membership or until their membership is canceled by Hatun İstanbul. Hatun İstanbul may unilaterally terminate the agreement by canceling the member's membership if the member violates any provision of the membership agreement.

  1. RESOLUTION OF DISPUTES

Bakırköy Courts and Enforcement Offices are authorized in disputes related to this agreement.

  1. EFFECTIVENESS

The member's registration means that the member has read all articles in the membership agreement and accepts the articles in the membership agreement. This Agreement was concluded and came into mutual effect at the moment the member became a member.
